Justos por Pecadores

Mucho se ha hablado ya sobre la crisis económica que estamos viviendo, las causas, sus culpables y las posibles teorías para evitar que esta coyuntura económica se vuelva a producir en el futuro. Pero lo que yo vengo hoy a contar es como dentro del mundo empresarial ha cambiado la percepción que tenemos sobre las entidades financieras a día de hoy.
La banca siempre ha estado presente en el mundo empresarial, ya que, por suerte o por desgracia, la empresa necesita financiación para funcionar. Hubo un tiempo en que las empresas y la banca iban cogidas de la mano, en una perfecta simbiosis para crecer y crear valor. Una aportaba capital para el correcto funcionamiento y un crecimiento necesario, mientras que la otra pagaba unos intereses en “agradecimiento” a ese servicio de préstamo de capitales.
Esta percepción de simbiosis perfecta hoy en día ha dado un gran giro. A pesar de parecer un tema tabú, pues en la calle no se comenta mucho, la verdad es que muchos empresarios y responsables financieros de empresas empiezamos a quejarnos sobre la actitud de los bancos.
Según nos comentaba D. Jesús Huerta de Soto, una de las causas de las crisis que vivimos cada cierto tiempo, es la “ficticia” expansión monetaria que crean las entidades financieras prestando dinero que no tienen, gracias a ese gran invento llamado coeficiente de caja. Con ello lo único que se consigue es que la cantidad de dinero puesta a disposición del mercado sea mayor que la que realmente es, y por tanto, llegue un momento en que la contracción económica sea inevitable. Esto unido a una mala praxis y, desde mi punto de vista, la poca ética demostrada por las entidades financieras, han hecho de esta crisis la más importante después del Crack del 29. Mucho sabemos ya sobre todo esto: activos mal valorados, ratings ficticios que no se ajustaban a la realidad, malabares de productos financieros con nombres extravagantes que nadie era capaz de entender y un sinfín más de prácticas dudosas con el único objetivo de ganar cada vez más y más dinero.
El problema viene cuando las propias entidades financieras y debido a la crisis -provocada por ellas- empiezan a apretar las tuercas a las empresas.
Todos hemos visto las reacciones y ajustes necesarios llevados a cabo por las organizaciones para poder sobrevivir: recorte del gasto -el más inquietante el de personal-, contención de nuevas inversiones y ajuste a la baja de los precios de venta de los productos son las más importantes. Es un esfuerzo descomunal que están haciendo todas aquellas empresas que quieren superar esta crisis sin desaparecer del mercado.
Pero como si esto no fuera suficiente, ahí están las entidades financieras: da igual que tu empresa haya hecho las reformas necesarias, que siga funcionando a pesar de todos los inconvenientes y que siga siendo solvente -casi milagrosamente-: la banca quiere “su” dinero.
Sus índices de morosidad se han disparado. Los incobros se suceden y la mejor forma de solucionarlo es “apretar” a aquellas empresas que siguen siendo solventes para conseguir bajar estos índices de morosidad.
Así los empresarios, además de no conseguir financiación para el funcionamiento adecudado de las compañías -se oye mucho lo de “se ha cerrado el grifo”-, vivimos un “estrangulamiento” provocado por la necesidad de los bancos de bajar sus índices de morosidad. “Si la empresa X me impaga un préstamo, no hay problema, lo recupero “apretando” a la empresa Y, que aunque sé que también las está pasando “canutas”, que se las busque como pueda para darme lo que le reclamo”.
Y así está pasando: carencias que desaparecen y exigencias de aceleración en las amortizaciones son dos de las acciones que yo he vivido en primera persona.
“Señores de los bancos”: mi empresa sigue siendo solvente y sigo luchando para que lo sea. ¿Por qué he de pagar yo sus excesos al dar préstamos a quién no debían? ¿No se dan cuenta de que la valoración que tenemos sobre sus entidades financieras está llegando a mínimos? Han pasado ustedes de ser un “compañero” en el camino empresarial a ser “el mal necesario” de nuestros días para funcionar.
Oigo a muchos compañeros decir que cuando pase esta crisis, cambiarán de entidad financiera. Pero a lo mejor es salir de Málaga para meterte en Malagón… Pues como ya he dicho, hoy ya son “el mal necesario” en nuestra aventura empresarial.

Realmente; ¿Hizo la banca algo distinto, de lo que realizaron las empresas y familias en el pasado periodo de expansión?
Nos encontrábamos en un ambiente de liquidez desbordada (materia prima), múltiples entidades financieras actuando en el sector, y una demanda ávida de cualquier producto, que tuviera una diferenciación; llámese mayor rentabilidad por una mayor asunción de riesgo, o un volumen mayor del préstamo hipotecario, aunque no fuera necesario.
Estoy segura que esta situación se estaba produciendo en todos los sectores, y no sólo el financiero.
¿Nos hubiera parecido lógico, en aquel contexto, que un promotor inmobiliario ante lo que podía considerar una buena oportunidad, no adquiriera suelo para levantar promociones, las cuales vendía totalmente antes de empezar el forjado? En su sector existía materia prima, alta competitividad y una gran demanda. La capacidad financiera real de acometer una inversión no podía ser un freno, porque si no, otro promotor compraría ese solar.
Una cadena de tiendas de venta al público, negocios de hostelería, servicios empresariales, no podían dejar de invertir en términos expansivos, porque si no se posicionaría la competencia. Existía el valor del coste de la perdida de oportunidad.
Y así en todos los sectores se produjo el sobreendeudamiento que lastran hoy las cuentas de resultados de los bancos, en forma de provisiones, y mora.
Todos vivíamos en un exceso, ahora vienen las correcciones, y de nuevo toca en todos los sectores. Los que todavía hoy son solventes, sufren restricciones y endurecimiento en las condiciones, no hay materia prima, la demanda no tienen capacidad de compra, y el mercado está eliminando a los competidores que han hecho “menos bien” las cosas.
No solo las empresas sufren restricciones al crédito, la banca también se ha visto adolecida por la pérdida de inversión de fondos internacionales, y el encarecimiento de los diferenciales, porque algunos bancos han realizado esa mala praxis de la Pepe nos hablaba y han contaminado a todo el sector.
No opino que en esta situación estén “pagando justos por pecadores”, sino que todos hemos tenido parte de culpa en la anterior coyuntura, y ahora debemos sufrir esta corrección para llegar a unos términos en donde la prudencia, e idoneidad, estén algo más presentes. “Que tire la primera piedra quien esté libre de pecado”(empresarialmente hablando)
¿Hizo la banca algo distinto al resto de los sectores? No sé, en principio sí: no creo q BMW vendiera coches anunciados de 8 cilindros y 500 cv que luego llevaban motores de 4 cilindros y 130 cv… Tampoco creo que ningún promotor vendiera casas con todos los acabados y que luego no tuvieran los muebles de la cocina o ni siquiera agua caliente… como sí hizo la banca con sus productos financieros, donde eran lo mejor de lo mejor y luego se descubrió que no…
El sobreendeudamiento que tienen los bancos es por haber concedido préstamos con un riesgo muy alto, por lo que ahora contraen el préstamo crediticio. Bien, hasta ahí me parece bien. Pero por qué mi empresa, que sigue siendo solvente, ve ahora modificadas las condiciones de la devolución de su deuda? Por qué los bancos ya no confían en mi empresa? O es porque necesitan recuperar capital que han perdido por otro lado?
Si en mi sector hago lo mismo, una vivienda vendida a un cliente sobre plano antes de la crisis la podría modificar: no, mira, que es que ahora la crisis está aquí, y lo q antes me compraste en mármol, pues ahora te lo voy a dar de gres, y lo que era aire acondicionado, pues te voy a poner unos ventiladores muy majos. No, no puedo hacer eso. Lo que hago es bajar un 30% el precio de las viviendas para poder seguir existiendo y ajustarme al mercado. Pero lo que no hago es ni bajar mi calidad, ni solicitar a mis clientes q me adelanten sus pagos aplazados. Ese es mi problema, y del que tengo que responder yo y nadie más. Si una entidad financiera ve que su mora crece, es su problema, no del resto de clientes que llevan trabajando con ella más de 20 años sin ningún tipo de problema. Mi empresa, la que jamás te ha dado un problema, es ahora a la que aprietas para que te saque las castañas del fuego? No me parece justo.
Es más, y como último apunte: dices “que todos hemos tenido parte de culpa en la anterior coyuntura, y ahora debemos sufrir esta corrección para llegar a unos términos en donde la prudencia, e idoneidad, estén algo más presentes”… Mi empresa lo está haciendo, como ya te digo, habiendo bajado un 30% los precios de venta de sus productos. ¿Han hecho lo mismo los bancos? Porque te aseguro que estoy viendo renovaciones de préstamos que pasan de un diferencial de 0,65 puntos a uno de 1,40 o 2 e incluso he llegado a ver un 2,5 de diferencial respecto al euríbor. Eso es una corrección en las entidades financieras?

Me pregunto qué medidas se podrían tomar para evitar la injusticia suscitada por los bancos exprimiendo empresas solventes para hacer frente a los altos niveles de morosidad. ¿Deben intervenir los poderes públicos? Y entonces, ¿debe cambiarse la política monetaria europea o la legislación de las entidades de crédito?
El problema que planteas es grave puesto que si no puede solucionarse convencionalmente entre las partes, las soluciones solo pueden venir impuestas desde los poderes públicos. Es evidente la incapacidad de nuestras fuentes materiales del Derecho para poner freno inmediato a la crisis. Por no decir que una modificación de la política monetaria europea me parece, a corto plazo claro, impensable. Imaginemos modificar o derogar el Tratado de Maastricht habiendo entrado el Tratado de Lisboa en vigor el 1 de diciembre de este mismo año.
Ahora bien, si se suscitan injusticias sociales o económicas, como la aquí planteada, se pueden entablar medidas directas para evitar esto. Pero imaginemos que por Ley se obliga a los bancos a dar crédito a las empresas solventes. ¿No se plantearían más problemas que soluciones?. Además de incidir sobre la libertad de actuación de entidades privadas, ¿cómo se haría valer este derecho?. ¿Habría que demandar a los bancos cuando nos nieguen el crédito? ¿Y el juez tendría que ejecutar concediendo él el crédito?.
Creo que una solución inmediata no puede venir desde la legislación. Al problema de “pagan justos por pecadores” sólo cabe que el empresario prevea la volatilidad de su banco a la hora de modificar las condiciones crediticias y planifique su actividad con conocimiento de que su banco no es un amigo, sino su banco. Porque el legislador, que es quien se encarga de las injusticias parece, que de momento no puede adentrarse en esto de forma inmediata y debe ponerse manos a la obra con la crisis reformando otros sectores del ordenamiento: tributario, mercantil y concursal, procesal, etc. Por su parte, en el seno de la Unión Europea habría de abrirse el debate de reformas estructurales sobre la Unión Europea a pesar del reciente Tratado de Lisboa.
Justicia es la constante y perpetua voluntad de dar a cada uno lo suyo.
Estoy con Marta Blanco en todo, se llevan años viviendo en el exceso en todos los sentidos, pero no sólo la banca, sino en la economía en general. En España, particularmente, creo que a la gente le gusta vivir por encima de sus posibilidades. Vivimos en una sociedad en la que el “disfrutar de la vida” y el aparentar están a la orden del día… Carpe diem que dirían…
De las ideas de Pepe, estoy de acuerdo con bastantes de las ideas que expones pero, por dar un poco más de picante al asunto, voy a comentar una serie de puntos:
Que las en entidades financieras son unas de las principales culpables de la crisis financiera, evidente. No obstante, no han hecho más que aprovecharse (éticamente mal) de la ambición y de la avaricia de las empresas. La crisis no ha de achacarse únicamente a la avaricia de la banca, un banco no da dinero si alguien no lo pide (o por lo menos antes, ahora incluso te llaman ofreciéndote créditos personales o incrementar un crédito que ya tienes!)… Las empresas también han querido lucrarse de la buena situación económica que había en España en particular y en el mundo en general. El afán por crecer de forma desmesurada ha creado esta situación… Aquí me acuerdo particularmente del sector de la construcción… El sobreendeudamiento de la banca es una consecuencia del sobreendeudamiento de muchas empresas que ha querido sacar provecho (al igual que las empresas) de la buena situación económica que vivimos los últimos años.
La valoración de activos no la hacen los bancos, las hacen las tasadoras que hacen sus estimaciones en base a una serie de modelos, medias, etc. El banco no es el culpable de una mala tasación… Por mi pequeña experiencia en este mundo, si hay un culpable aquí es el empresario que es el que finalmente “achucha” a la tasadora para que le suba un poquito el valor de la tasación (y así el banco le dé más dinero). Después de la tasación si que me parece un error que un banco de un crédito por el 100% del valor de un activo, por mucho que sea estupendo, esté muy bien situado, genere unas rentas o lo que sea. En este aspecto yo me considero bastante conservador y creo que siempre hay que ponerse en lo peor a la hora de analizar una operación ya que como bien siempre ha demostrado la historia, en el mundo de las finanzas no siempre vienen bien dadas…
Comentas que tu empresa, ahora paga las consecuencias de la crisis… es una “putada”, pero es ley de vida…siempre pagan justos por pecadores. Pero vamos, que no sois los únicos… La crisis la estamos pagando todos, ya seamos justos o pecadores. Así de “injusta” es la economía…
“Te aseguro que estoy viendo renovaciones de préstamos que pasan de un diferencial de 0,65 puntos a uno de 1,40 o 2 e incluso he llegado a ver un 2,5 de diferencial respecto al euríbor. Eso es una corrección en las entidades financieras?” No es una corrección, simplemente es la clásica ley de la oferta y demanda… Antes había mucha liquidez y ahora no la hay, y la poca que hay, hay que pagarla.
La banca también ha hecho sus correcciones (cerrando sucursales, recortes de costes, despidos, etc.), pero si su única fuente de ingresos es el préstamo de dinero y este, cada vez es más caro, normal que hayan subido lo que piden por él…
Me temo Pepe que tu ejemplo ha sido muy poco afortunado. Evidentemente que pagan “justos por pecadores”, pero, sinceramente, es “ley de vida”, ya que ocurre en todos los ámbitos. Sin embargo, si existe un sector en el que ha habido y hay más pecadores que justos, es en el de la construcción. Ya que, muchas empresas, no sólo cambian el mármol por gres, sino que cobran la entrada para una vivienda y ni tan siquiera tienen licencia para construir.
Que la banca ha puesto su granito de arena en la crisis actual, totalmente de acuerdo. Pero en el carro expansionista iban subidos muchos, y los que ocupaban más asientos eran las promotoras y constructoras.
En cuanto a que los bancos exijan unas condiciones más duras en cuanto a precio o devolución de la deuda, no es para mejorar sus ratios de mora.
Las provisiones por mora son datos absolutos y no se mejoran más que con recuperación de esa deuda en concreto y evitar nueva mora, no endureciendo las condiciones a otros clientes solventes.
Creo que la desaparición de carencia, y demás exigencias corresponde a cambios en las políticas de riesgos de las entidades, anteriormente más permisivas por motivos comerciales. Un producto poco diferenciado de una entidad a otra como un préstamo, había que endulzarlo para hacerlo más atractivo con variantes en cuanto a precio y plazo de devolución. Los criterios de riesgo predominan ahora en cuanto al comercial.
Las entidades recortan su exposición en todas las empresas en las que han concedido préstamos. Vemos como grandes empresas están teniendo problemas para refinanciar sus deudas, porque la banca extranjera no está dispuesta a mantener un euro en el sector ladrillo en España.
No debemos demonizar a un sector/ores en especifico, en vez de trabajar por estructuras empresariales más solidas en su estructura de financiación, y más competitivas en su actividad.
